Because of the high cost for U.S. Government to store and maintain seized property, such as homes, boats, and vehicles, it is problematic police increasingly might direct their efforts toward the forfeiture of non-tangible assets such as intellectual-property. Since the real estate crash, police incentive to “civilly forfeit” homes is less—as millions of unsold homes among boats, planes and cars litter the U.S. landscape.
Economics may force more police to adapt to reading business faxes, emails and other electronic communications to forfeit “intangible assets”, believed involved in crime, property that can be sold. U.S. Government does not use “Clear and Convincing Evidence” to “civilly forfeit” property, only a "preponderance of evidence", little more than hearsay. Article By Howard Witt, Chicago Tribune describes Tenaha, Texas—How African Americans and other motorists entering the town, were stripped by police of their belongings: cash, jewelry and other valuables without charging them with a crime. Asset forfeiture victims had to sign over their property to the town or face felony charges. This is an enormous story of police forfeiture abuse.

In Harrisburg, Pennsylvania, the Pennsylvania Supreme Court ruled March 26 that a judge could throw out as many as 1,200 convictions of juveniles sentenced by a Luzerne County judge who agreed to plead guilty in March to taking bribes from a detention center owner to ensure he had a steady supply of juvenile offenders to house. Former Luzerne County Juvenile Court Judge Mark Ciavarella and his colleague, Judge Michael Conahan, agreed to cop a plea to taking $2.6 million in bribes from PA Child Care LLC and Western Pennsylvania Child Care LLC to send juveniles to prison for months for small-time offenses including possession of a pot pipe. The two crooked judges are looking at 87 months in prison each.

 

The REAL Reason Hemp/Marijuana was MADE Illegal

How DID True Hemp ( Cannabis sativa,sub-species sativa ) disappeag from American-family-hemp-farms? Starting in the late 1920's, forest-products, cotton, oil, petrochemical, steel, and perhaps even aluminum industries feared COMPETITION from a very innovative new technology; the HEMP DECORTICATOR.

HEMP DECORTICATORS were just becoming commercially-available on True Hemp farms. This key technology would have allowed family farmers to create a carbohydrate economy to replace what is now a system dominated by hydrocarbons (oil, coal, and natural-gas).

In fact, in the February, 1938 edition of Popular Mechanics, hemp was heralded as a 'New Billion Dollar Crop'. Exactly what caused the demise of True Hemp commodity farming? Well, in 1917 George W. Schlicten pulled off a sort of Eli-Whitney-cotton-gin stunt, only way better....he patented the HEMP DECORTICATOR; a farm-machine that mechanically separates the fiber in the True Hemp stalk. This labor-saving device was just barely beginning to kick some centralized-polluting-corporate-butt in the late 1920's.

Coincidentally, this is exactly when a deliberate smear campaign was launched (by print, newsreel, and radio) to discredit what was THEN a very new and mysterious word: marijuana. A negative image was assigned to that now-dreaded M-word. Non-drug, True Hemp simply had to be stopped (if youwere a wealthy industrialist, that is....)

Although the indica sub-species may or may notcompete with patented, synthetic, man-made-chemicals that can be centrally controlled by pharmaceutical corporations, Sativa sub-species-non-drug-True-Hemp commodity COMPETITION is what very big business actually
stopped (by clever deception).

As Frances attempted to open the door, a narcotics task force from the LA County Sheriff's Dept. burst into the home, weapons in hand.<br/>Frances was pushed forcefully from the door at gun point. She cried out, "Don't shoot me, don't kill me!" With a gun aimed at her head, Frances looked to her right and saw Donald charging into the room, waving a revolver above his head. She heard a deputy shout, "Put the gun down! Put the gun down! Put the gun down!" As Scott was doing so, Frances heard three gun shots ring out, apparently from two sources.<br/>Her husband was killed instantly.<br/>Scott was a millionaire who owned 250 acres of breathtakingly beautiful land that was adjacent to federal park lands. Attempts had been made by the feds to buy the property, but Scott was not interested in selling. Claims that there might be pot growing on the land, made by agents who did aerial surveillance, were used to get a search warrant.<br/>An official inquiry suggested that agents had hoped this raid would lead to asset forfeiture of the property Scott would not sell. The coroner's report listed the cause of death as a homicide. No marijuana was found. Scott did not even smoke it. In January, 2000, the Scott family won a $5 million wrongful death settlement from the government over the shooting.<br/><br/><strong>Gerardo Anthony Mosquera Jr. </strong><br/>Age seventeen at his time of death from a self-inflicted bullet to his head in 1998. Gerardo Mosquera, Jr., a teen who took his studies seriously and worked after school to help support his family, became despondent when his father, a legal resident in the US for 29 years, was deported by the INS in December, 1997.<br/>Mosquera Sr., 38, was sent back to Colombia, his native country that he hardly knew, despite the fact his wife and children were born in the US and he was gainfully employed as a forklift operator. His father's deportation came as a result of a crackdown on so-called "criminal aliens." His sole felony conviction stemmed from the sale of one $10 bag of marijuana to a police informant in 1989. As this law bans people from ever returning to the US, he was even denied permission to return for his son's funeral.<br/> <br/><strong>Chad MacDonald</strong><br/>When told he was facing a lengthy jail sentence after being arrested with about a half ounce of methamphetamine, seventeen year-old high school student, Chad MacDonald, agreed to act as an informant for the Brea Police Department in California.<br/>The pressure he was under to make a buy large enough to satisfy the police and avoid prosecution on his charges led directly to his torture and death at a suspected drug house on March 3, 1998 and the rape and shooting of his sixteen year-old girlfriend, who had accompanied him. Revenge was alleged as the motive in court documents filed on two suspects who were arrested for the attacks.<br/>Following assurances that her son would not be in danger if she agreed to allow him to act as an informant as they proposed, his mother, Cindy, signed the department's release form. This allowed Chad to go home. At that time, she was unaware that the arrangement involved Chad wearing a wire while making a buy until after one had taken place. Chad had confided in his mother that he felt pressured to make increasingly larger buys and that detectives had said his three previous undercover buys were not enough to make his legal problems go away. Mrs. MacDonald repeatedly told police that she had wanted him to end the arrangement.<br/>Had she been advised that he could have qualified for a high intensity drug treatment program rather than faced hard time in custody, she would have jumped at it. Mrs. MacDonald believes her son would be alive today if the police had handled his case differently.
